Residence permit for the spouse of a Polish citizen
The most privileged family status in Polish law: the law requires the citizen's spouse to have neither income, housing, nor insurance, and illegal stay is not grounds for refusal. In exchange, the state checks one thing — the authenticity of the marriage. What does the voivode check?
There are very few formal conditions — so the entire review focuses on the marriage's authenticity and the citizen-spouse's ties to Poland.
A recognized marriage
A marriage recognized under Polish law. If it was concluded abroad, the certificate is transcribed (umiejscowienie) in a Polish USC; the package includes a recent odpis no older than 3 months.
The citizen-spouse lives in Poland
The Polish citizen's center of life interests must be in Poland: work, address, everyday life. If the couple has only just returned from abroad, this point requires separate preparation.
Authenticity of the marriage
Art. 169: separate interviews for each spouse, a check of cohabitation, and a possible Border Guard wywiad at the address. They assess shared everyday life, the language spoken between you, and how well you know each other's lives.

Spouse of a Polish citizen vs. a foreigner's family
Two family routes are often confused — yet the difference between them is dramatic: from income requirements to the speed of the path to citizenship.

Partners without an official marriage, including same-sex couples, can also legalize their stay in Poland. This route requires more careful preparation, but it is possible. We cover it in detail in the FAQ.
What the citizen-spouse card provides
Work and business without restrictions
Free access to the labor market without permits, plus the right to run a JDG on equal terms with Polish citizens — from the first day the card is valid.
Zero financial conditions
The only residence-permit category with no requirements for income, insurance, or housing: the law protects the family rather than checking your wallet.
Protection under art. 165
An expired visa or illegal stay cannot be the sole reason for refusing the spouse of a Polish citizen — a rare legal privilege.
Fast permanent residence
The “3 + 2” formula: three years of marriage and two years of continuous residence on a marriage-based card — and you can apply for indefinite pobyt stały.
Citizenship within a 4-year horizon
After 2 years on permanent residence (with 3+ years of marriage and Polish at B1) — an application for recognition as a citizen. The shortest marriage-based path to an EU passport.
Status doesn't collapse in hard times
Divorce or the spouse's death doesn't automatically cancel the card: where there's a significant interest, the law grants your own permit for up to 3 years.

From 27 April 2026, the application is filed electronically through MOS, signed personally via profil zaufany. We support the online filing; next comes biometrics by appointment with the voivode.

Common refusal reasons — and how we address them
This ground has one Achilles' heel — doubt about the marriage's authenticity. Almost every refusal grows from there.
Suspicion of a sham marriage
Separate interviews, an address check, neighbors' statements (art. 169). We prepare the couple for the interview and gather a dossier: everyday life, finances, relationship history.
Marriage not recognized under Polish law
A foreign certificate without transcription stalls the case. We carry out umiejscowienie in the USC before filing.
The citizen-spouse actually lives abroad
The voivode checks the couple's center of life interests. We help confirm its relocation to Poland: work, address, accounts, doctors, children's school.
Contradictions in the spouses' statements
Differing answers about everyday life and the couple's history are the main trigger for refusal. We go through typical interview questions with you before your visit to the office.
A missed request from the voivode
Correspondence is electronic — we keep a case calendar and respond on time.
Lack of supporting documents
Although proof of income and other documents may not be required, they help demonstrate the center of life interests in Poland. We analyze the situation and recommend documents that strengthen the applicant's position.
A refusal can be appealed within 14 days via the voivode to the Urząd do Spraw Cudzoziemców. We also challenge findings of “sham” status — with new evidence.
